Our affiliate program represents an opportunity to promote the highest quality CBD products on the market, while being rewarded for doing so. The following affiliate agreement is written with our successful partnership in mind, and for that reason, we ask that you take a few minutes to understand the terms of this agreement.

THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND CIBDOL (WWW.CIBDOL.COM)

BY SUBMITTING YOUR ONLINE APPLICATION, YOU AGREE THAT YOU HAVE READ THE TERMS AND CONDITIONS OF OUR AFFILIATE AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR ALL POINTS LISTED.

1. Overview

1.1 This agreement contains all of the relevant terms and conditions necessary for the Cibdol affiliate program. This agreement will allow for linking between your website and www.cibdol.com via HTML.

2. Affiliate Obligations

2.1 To become an affiliate, you will be required to complete the registration process on www.idevdirect.com. Although some applications may be approved automatically, this does not imply that we will not re-evaluate our partnership, or choose to terminate your role in the affiliate program if you breach any of the following conditions:

promote violence, sexually inappropriate or suggestive material, illegal activities, or discrimination based on race, sex, nationality, religion, age or sexual orientation. We may also terminate your role in the affiliate program if you infringe any copyright material, trademarks or intellectual property rights that are not your own. Finally, you may not design or produce a website in a manner that resembles our own (www.cibdol.com) or use software downloads that impact the commission payments made to yourself or other affiliates.

2.2 Successful Cibdol affiliates will have access to a dashboard via www.idevdirect.com. Your dashboard will allow access to the relevant HTML links and promotional material. In order for Cibdol to keep track of visits to our site from yours, you will be required only to use the HTML code provided for each type of promotional material.

3. Cibdol’s Rights and Obligations

3.1 Cibdol reserves the right to review the placement and approval of the links provided to ensure they are in keeping with the agreement guidelines, and we may monitor your website as a result of this process. If any changes we feel are necessary to your website are not implemented, we may choose to terminate your participation in the Cibdol affiliate program.

3.2 Cibdol reserves the right to terminate your affiliate agreement without notice should you commit fraud or abuse the program in any way. Should these actions take place, Cibdol will not be liable for any commissions earned on fraudulent transactions.

3.3 This agreement will begin once your affiliate application has been accepted, and will continue until terminated by Cibdol or yourself.

4. Termination

4.1 Either you or Cibdol may end this agreement at any time, regardless of circumstances, by giving the other party written notice. Both written letter and email are acceptable forms of written notice. This agreement may also terminate without notice should any of the terms detailed become violated.

5. Amendments

5.1 Cibdol may choose to modify the terms and conditions outlined in this agreement. However, if we decide to do so, we will notify you via email. Changes may include (but are not limited to) modifications to the rules or regulations surrounding affiliate payment schemes and commission-based rewards. If you continue to act as an affiliate partner after being notified of the changes, Cibdol will take this as consent. If you do not agree with the changes made by Cibdol, your only option is to end the agreement by following the termination process.

6. Payment and Tracking

6.1 Cibdol uses www.idevdirect.com to monitor tracking and payment. Full details of the payment scheme, commission requirements and eligibility gateways can be found as part of www.idevdirects.com’s payment terms and conditions. To access this information, you will need to create an account with a password on www.idevdirects.com.

7. Cookies

7.1 Cookies used as part of the affiliate program have a 30-day duration. Only users who make a purchase while cookies are active will be considered referrals of the affiliate and be recorded as such. If a potential customer clears their cookies during this period, Cibdol is not responsible for any commissions that may be owed to you.

8. Promotional Restrictions

8.1 As promotional material with the Cibdol name could be interpreted as a business partnership, it is essential that any campaigns or advertising practices are in keeping with the values of Cibdol. The following activities and forms of advertising are prohibited by Cibdol:

spamming, whether through the use of unsolicited commercial emails (UCE), or mass-posting to social media platforms; concealing or misrepresenting your identity by hiding your domain name or return email address; misspelling or alteration of keywords related to pay-per-click campaigns and falsifying potential leads with incorrect information.

8.2 If the affiliate is highlighted as breaching any of the conditions listed under (8. Promotional Restrictions), we reserve the right to terminate the agreement. Any pending balances will not be paid if the agreement is breached due to infringement.

9. Association of the Parties

9.1 Both parties are deemed independent contractors, and no part of this agreement signifies a business partnership, joint venture, agency, franchise, or employment relationship between parties. You, the affiliate, do not have the authority to make or accept any offers or statements on behalf of Cibdol.

10. Grant of Licenses

10.1 Cibdol grants you the rights and licences stated explicitly in this agreement. You are not entitled to any other rights or permissions with respect to Cibdol or any of its products, trademarks or any other property, intellectual or otherwise.

11. Confidentiality

11.1 Business, financial, technical and customer information disclosed during the agreement process, or as part of the affiliate agreement, will remain the sole property of the disclosing party. Either party will not disclose this information without express written permission.

12. GDPR

Definition: “Applicable Data Protection Law" denotes any and all applicable privacy and data protection laws and regulations applicable to the personal data in question.

12.1 Both parties acknowledge that as part of the affiliate program, either party may access personal data relating to the proposals in this agreement, or as permitted by Applicable Data Protection Law. This sharing of protected personal data will not be jointly controlled, and either party will process the personal data in their possession as an independent controller. This independence extends to any obligations necessary under Applicable Data Protection Law, and neither party is responsible for the other's compliance with these guidelines.

13. International Data Transfer

13.1 Where Applicable Data Protection Law is in the European Economic Area (EEA) or its member states, neither party will process EU personal data outside of the areas listed, unless steps have been taken to comply with any necessary or additional Applicable Data Protection Law.

14. Security

14.1 Both parties will implement and maintain the necessary technical and organisational measures to protect copies of personal data in their possession. This includes the risk of unlawful or accidental destruction, loss, alteration, or unauthorised access. Should any of these conditions take place, both parties will notify the other of breaches to Applicable Data Protection Law.

15. Limitation of Liability

15.1 The Cibdol affiliate program is provided on an “as is” and “as available” basis. The use of such a program is entirely at your own risk. Cibdol makes no representations or warranties, either expressed or implied, with regards to the affiliate program or any service provided.

15.2 You hereby agree to indemnify and hold harmless www.cibdol.com and its subsidiaries and affiliates, and their directors, employees, agents, shareholders, partners, members and other owners against any and all claims, actions losses, demands, liabilities, damages, judgments, settlements, costs and incurred expenses, in as much as such losses are the results of your participation in the affiliate program, our use of the data provided, or your non-compliance with the terms of this agreement.

16. Disclaimer and Warranties

16.1 Cibdol makes no warranties, expressed or implied, that our site will be uninterrupted or error-free, nor does Cibdol make any warranties about its products or services being fit for a particular purpose or intended use.

17. Miscellaneous

17.1 This agreement represents the entire agreement between us and will supersede any and all prior agreements whether written or verbal.
